The California Apartment Association has filed a letter with the California Supreme Court, urging the court to hear an appeal in NCR Properties v. City of Berkeley.

The lawsuit challenges Berkeley’s application of its local rent control ordinance to several housing units that received new certificates of occupancy following substantial renovation. The property owner contends that Costa-Hawkins exempts the properties from the city’s rent control law because the properties were issued new certificates of occupancy following their rehabilitation.
