The California Apartment Association remains committed to challenging the legality of Alameda County’s never-ending COVID-19 eviction moratorium, despite a recent unfavorable ruling by the judge in the case.

On Nov. 22, Magistrate Judge Laurel Beeler denied CAA’s motion for summary judgment, which requested a ruling in CAA’s favor now — instead of at trial — on some “facial” or baseline constitutional questions in the case. Beeler also rejected a motion for summary judgment in a companion case challenging both the county’s moratorium and Oakland’s.
