The statewide state of emergency tied to Avian Influenza A, commonly known as bird flu, expired on Jan. 17, 2025, without renewal. Declared in December 2024, the emergency capped rent increases statewide at no more than 10% above pre-emergency levels under California’s anti-price gouging law, Penal Code Section 396. With its expiration, rent-gouging protections triggered by this emergency are no longer in effect.
However, California landlords remain subject to rent increase limits in jurisdictions impacted by other emergencies. Protections tied to the Palisades Fire in Los Angeles and Ventura counties remain active, capping rent increases through March 8, 2025. These protections also apply in areas of the state experiencing heightened housing demand resulting from the fire-related displacement.
