In a positive development for rental housing providers nationwide, a federal appeals court has left in place a key ruling that supports landlord claims for compensation over government-imposed eviction bans during the COVID-19 pandemic.

On June 6, the U.S. Court of Appeals for the Federal Circuit declined to revisit its recent decision in Darby Development Co. v. United States, keeping intact a pro-landlord ruling that may soon reach the U.S. Supreme Court. The case could result in a landmark decision on government accountability for COVID-era eviction bans.
