The San Diego County Counsel’s Office has responded to CAA’s May 6 letter requesting guidance on ambiguities in the rent control and just-cause eviction ordinance adopted this month by the Board of Supervisors.

CAA’s letter raised a number of issues, including:

  • A definition of the consumer price index that was insufficient to allow rental housing providers to determine the limit on rent increases.
  • Ambiguity as to whether the ordinance applies to rent increases noticed or agreed to prior to the ordinance’s effective date.
  • A failure to recognize that single-family homes, condos, and properties built after Feb. 1, 1995, are exempt from local rent control under the Costa-Hawkins Rental Housing Act.
