The city of Oakland has preliminarily approved an ordinance that would prohibit landlords from conducting criminal background checks or asking prospective tenants whether they have a criminal record at any time during the application process.

The proposal, officially the Fair Chance Housing Ordinance, would also bar rental housing owners from rejecting applicants for tenancy based on criminal records.
