This form is for properties that (1) are subject to AB 1482 just cause and (2) have a fixed term lease under which the lease expires at the end of the term. If you want the Resident(s) to enter into another fixed term lease of similar duration, you can use this form to make that offer. Alternatively, if you simply accept rent from the Resident after the end of the lease, a month-to-month periodic tenancy is created, and the other terms of the old lease remain applicable. If the Resident accepts this renewal offer and both parties execute the Renewal Addendum attached to the offer, the Renewal Addendum becomes a binding and legally enforceable contract. If the Resident refuses to execute the Renewal Addendum, that refusal may constitute “just cause” to terminate the tenancy under AB 1482. This form also gives the Resident(s) the option of affirmatively indicating their non-renewal of the lease.
