Notice of Applicability of San Jose Rent Freeze to Pending Rent Increase With Blank Declaration of COVID-19-Related Financial Distress – City of San Jose
On February 2, 2021, the San Jose City Council adopted a rent freeze ordinance. This ordinance places a moratorium on rent increases for residents of rent controlled units who have experienced COVID-19-Related Financial Distress.
This ordinance prohibits a landlord from collecting a rent increase that was pending as of February 2, 2021 unless: (a) the landlord provides to the resident with a Declaration of COVID-19-Related-Financial Distress, and (b) the resident does not submit to the landlord a signed copy of such declaration before the later date of either the effective date of the rent increase or fifteen days after receiving the declaration.

Do not use this form if you are increasing the rent during the term of the rent increase moratorium. Instead use Thirty-Day Notice Of Change Of Monthly Rent With Blank Declaration Of COVID-19-Related Financial Distress – City Of San Jose (Form SJ-002). This form is only for previously issued rent increases which had not yet gone into effect as of February 2, 2021.
